Abstract The sexual crime, especially rape, can be committed without the practice of carnal conjunction or even physical contact with the victim, known by some as subjective rape. The objective of this scientific article is precisely to deepen the descriptive studyof this type of sexual offense, covering its origin to its treatment in the Penal Code, through its legal foundations. Thus, "The coercion of the victim to carnal conjunction and also to various lewd acts other than carnal conjunction, once provided for in article 213, become crimes of the same nature, allowing for the recognition of continued crime between such offenses. One cannot use a restrictive concept of manner of execution to exclude the continuity of the offense, as this represents an oblique attempt to modify the command extracted from the text of the new Law."
